ACTA: REUNIÓN CELEBRADA ENTRE LA CONSEJERÍA DE VIVIENDA Y OBRAS PÚBLICAS Y SAVE OUR HOMES AXARQUIA (SOHA.ES).

ACTA:
Doña Rosa Urisoste realiza un repaso de la situación actual de los trabajos realizados, por la Consejería, en materia de normalización de las viviendas en la Axarquía y señala que en cuanto a los inventarios (documentos que analizan las viviendas irregulares en los diferentes municipios) ya se han realizado en 31 municipios. Los municipios de Archez y Canillas del Aceituno se niegan a realizar su inventario y Alcaucín está en elaboración. Los inventarios ya finalizados se presentarán, la semana que viene, a la Consejera para su conocimiento y visto bueno.
Igualmente, en algunos municipios se están redactando sus respectivos Planes Generales, entre ellos La Viñuela.
Se anunció, por parte de Doña Rosa Urioste, que en un plazo aproximado de diez días, la Consejera estará en Málaga y es muy posible que adelante alguna noticia relacionada con los inventarios.
Como novedad, se comunica que se está redactando una normativa que va a regular el régimen jurídico del suelo no urbanizable, cuyo espíritu será, entre otros, intentar dar cabida a las viviendas construidas en suelo no urbanizable y su compensación para su regularización. Esta norma, que aun no se conoce su rango normativo, estará terminada en un plazo aproximado de dos meses.
Don Philip Smalley plantea una cuestión sobre las denuncias realizadas a algunas viviendas en la Axarquía, y si éstas han sido incoadas por la propia
Consejería. A este respecto, Don Antonio Jesús señala que las denuncias que se está produciendo no provienen de la Consejería sino que son presentadas por vecinos de los municipios y que la Consejería, como administración, tiene la obligación de darles cursos a las que procedan. Igualmente aclara que estos últimos dos años, la Consejería no ha incoado denuncia alguna sobre viviendas en la Axarquía.
Don Philip Smalley y Don Gary Miles plantean un problema que es la falta de conocimiento que tienen algunos técnicos municipales sobre las normativas que regulan el urbanismo en Andalucía. Esta inquietud es respondida por Doña Rosa Urioste anunciado que desde la aprobación del nuevo Reglamento de Disciplina se ha venido realizado cursos de formación a los técnicos municipales que hayan estado interesados y que este planteamiento, se va a seguir realizado en los próximos tiempos. Tal es el empeño, de la Junta de Andalucía, que se va a crear un “manual de funcionamiento” para que los técnicos locales sepan aplicar el procedimiento necesario en cada caso. A lo que Don Philip Smalley propone que también se haga en lengua inglesa o al menos un folleto, en ingles, donde se explique cómo proceder ante las Administraciones.
Don Philip Smalley plantea una duda relacionada con las licencias urbanísticas y pregunta porque, cuando se expide una licencia, aparecen varios sellos, entre ellos, el de la Junta de Andalucía. Cuestión contestada por Don Antonio Jesús, aclarando que en una licencia de obras no puede aparecer nunca un sello de la Junta de Andalucía porque la competencia para otorgar licencias es exclusiva de los Ayuntamientos.
Finaliza la reunión y se emplaza la próxima para mediados del mes de marzo.

Señora Rosa Urioste (Director General of Inspection – Junta) summed up the situation regarding the Works authorised by the Consejeria (Ministry) with regard to the normalisation of the houses in the Axarquia. She indicated that in terms of the inventories (analytical details of the irregular houses in the Axarquia) they have now been completed in 31 municipalities. The municipalities of Arches and Canillas de Aceituno have refused to do an inventory and Alcaucin is still being done. The inventories that have been done will be presented in the coming week to the Consejera (Director) for her knowledge and approval.
It was also announced by Señora Urioste that in approximately ten days the Consejera will be in Malaga and that she will be announcing some news regarding the inventories.
At the same time in some municipalities including Viñuela, the Society of Planning and Development (SOPDE) which is a department of the Diputación Provinicial de Malaga is working alongside the town hall to produce their PGOUs.
It was communicated that a regulation (rule) is being drawn up that is going to adjust the legal requirements of “Suelo no Urbanizable”, the spirit of which will be, amongst others, to try to legalise the houses constructed on non-urbanisable land and to clarify the compensation for their regularisation (n.b. compensation means contribution to bringing up to urban standards, i.e. infrastructure works where necessary). This ruling whose range is still not known will be finished in approximately two months.
Philip Smalley (President of SOHA.ES) asked a question regarding denuncias made against some houses in the Axarquia and if they have been initiated by the Consejeria. In this respect Antonio Jesus indicated that the denuncias which are being produced do not start from the Consejeria but are presented by neighbours in the municipalities and that the Consejeria, as administers of the law are obliged to process them. Equally he stated that in the last two years the Consejeria itself has not started any denuncias against houses in the Axarquia.
Philip Smalley and Gary Miles stated that one of the problems is the lack of knowledge that the technical staff of the Ayuntamientos have regarding the rules that regulate urbanism in Andalucia. This was responded to by Señora Urioste announcing that with the adoption of the new Rule of Urban Discipline, courses are being organised for the municipal technicians which will come into effect in the coming months. The effort of the Junta will be in creating a ”Manual of Procedures” that the local technicians should know and be able to apply in each case. Philip Smalley proposed that it should be in English as well or at least a leaflet should be provided which explains how to proceed with the authorities.
Philip Smalley asked why, when issuing a license, there appear to be several seals and yet, the one of the Junta de Andalucía is not shown. Antonio Jesus answered that the power for issuing licenses lay with the local Ayuntamientos and that for this reason the Junta’s seal could not appear.
The meeting ended with an agreement to meet again in March.
