On Monday 21st March at 7p.m., in the Bar Ortogosa at Cruce Zalia, SOHA.ES’S Committee met with Marta Escriva, who was elected to represent the Cuidadanos Party in the Andalusian Parliament at the last elections for the autonomous region. Marta, who lives in Sevilla, and is the Ciudadanos spokesperson regarding the Parliamentary Commission on Environment and Planning, is combining her visit to Axarquia with another to Mijas, where there are also housing problems. On Tuesday she will be escorted around the Alta Axarquia area, by Phil Smalley and Fernando Montero, to see first-hand some of the housing and planning problems, before moving on to Mijas.
Leading the informative discussion were Mario Blancke, Mayor of Alcaucin, and Phil Smalley, President of SOHA.ES. Both stood for election as members of Ciudadanos in the recent local elections.
Marta made it clear that Ciudadanos are still very supportive of SOHA.ES’s agenda to protect the rights of Axarquia residents.
The discussion concerned the amendments to the LOUA which are currently awaiting ratification by the Junta. The SOHA.ES leaders explained that their first concern is to ensure that the changes proposed in the parcelation rules must include properties which already have a procedure against them.
The second concern is that after the amendments have been passed, many properties will still have the threat of a challenge to the legality of their building licences, but this could be most easily avoided by the Junta’s favourably interpreting the planning laws. The Junta’s current interpretation of the phrase “a reasonable period of time” in which to challenge building licences (after the issue of a non-legal licence), is not defined. If the Junta chose to accept 8 years as “a reasonable time”, then very many homes would become safe from challenges to their licences, which mostly were issued eight or more years ago.
The third concern is over the plight of Spanish small-holders, following their tradition of building homes on their families’ lands, piece by piece, with their own hands, as the time and money became available. They need some legislation which would save them from demolition of their homes, possibly with the proviso that their home is substantially near completion.
The SOHA.ES reps also pointed out the economic benefits of keeping the ex-pat community here on the Costa. It brings huge revenue into Spain.
Ciudadanos are currently in a strong position in the Andalusian Parliament. Also the PSOE have been sympathetic to the cause of solving these problems.
La Diputada por CUIDADANOS en el Parlamento Andaluz, Marta Escrivá, se reúne con la Junta Directiva de SOHA.ES.
El lunes 21 de marzo a 19:00, en el bar Ortigosa en Puente Don Manuel, la Junta Directiva de SOHA.ES se reunió con Marta Escrivá, que fue elegida como Diputada por el Partido Ciudadanos en el Parlamento Andaluz en las últimas elecciones de la Comunidad Autónoma. Marta, que vive en Sevilla es la portavoz de Ciudadanos en la Comisión Parlamentaria de “Ordenación del Territorio (urbanismo) y Medio Ambiente.
Esta ha sido una visita a la Axarquía para conocer los problemas de las viviendas en el campo de primera mano. El martes estuvo visitando toda la Alta Axarquía acompañada por Phil Smalley, y conociendo sobre el terreno los diferentes tipos de problemas con las viviendas para tratar de dar las soluciones más adecuadas.
La exposición informativa fue dada por Mario Blancke, alcalde de Alcaucín, y Phil Smalley, presidente de SOHA.ES. Marta Escrivá dejó claro que Ciudadanos siguen estando a favor de la agenda de SOHA.ES para proteger los derechos de los residentes de la Axarquía.
El debate se centró en las enmiendas a la LOUA, que actualmente están en espera de la ratificación por la Junta. Los líderes de SOHA.ES explicaron que su primera preocupación es asegurar que los cambios propuestos en las normas de parcelación deben incluir las propiedades que ya cuentan con un procedimiento en contra de ellos.
La segunda preocupación es que después de que se hayan aprobado las enmiendas, muchas de las propiedades todavía tendrán la amenaza de un desafío a la legalidad de sus licencias de construcción, pero esto podría evitarse más fácilmente por la Junta interpretando favorablemente las leyes de planificación. La interpretación actual de la Junta de la frase “un período razonable de tiempo” en la que desafían las licencias de construcción (después de la emisión de una licencia no legal), no está definido. Si la Junta eligió aceptar 8 años como “un tiempo razonable”, a continuación, muchos hogares se volverían a salvo de los desafíos a sus licencias, que en su mayoría fueron emitidas hace ocho años o más.
