Senate Add “No Demolition Without Compensation” to Civil Law
The Priors and SOHA.ES attend the Senate Weds 24.06.2015 .
Associations say, “Avoid more cases like this.”
The Priors spoke about their case to Spanish Senators on Wednesday.
Their building licence, which had been acquired in good faith, was canceled. They lived in their garage for seven years,
while they waded through a legal morass asking for compensation. After all this they are still without it!
The Senate voted on an amendment to the Civil Code reform, which will allow a judge to postpone the demolition
of illegal dwellings which were bought in good faith, until compensation to their owners is secured.
A similar change to the Criminal Code was passed by the Senate in March this year.
The association AMA originally mooted the initiative. AMA is now supported by AUAN , SOHA.ES , CALU , FAUN , and EVEN.
Some 60 representatives of these associations, from widely different parts of Spain, attended a press conference in the Senate
at 13:15 , to lobby various political groups. So these groups started the initiative, lobbied strongly in support of it, and
funded their lawyer Gerardo M Vazquez to draft the amendment. They showed great unity, while being geographically widely separated.
The political party PSOE, and Parliamentary group EPC were expected to support the amendment, as well as the PP in Cantabria .
There had been certain indications that the PP would favour these changes to protect bona fide third parties , in line with the
recent change to the Criminal Code. However it was unclear how they would vote in plenary on Wednesday.
Finally the Senate vote was almost unanimous (a single vote against) in accepting the amendment in the law.
The resulting change is unfortunately too late to help the Priors. It is hoped that it will prevent this dreadful injustice happening to others.

I have only been a member of SOHA.ES since the beginning of the year. During this short time I have become very much aware
of the amazing job you and all concerned do for all of us members of SOHA.ES.
My brother and I have inherited a property in Alcaucin, with all its supposed illegal problems.
We are not experienced in owing a property in Spain – which is extremely daunting in itself – let alone with all these
illegal problems added on top !
To have the support of an organisation like SOHA.ES and all the very good people like yourself is very comforting and reassuring.
We very much appreciate all your hard work and commitment you give to SOHA.ES on behalf of us all.
You have given us a light at the end of a very dark
tunnel – THANK YOU !!!!

Senado Añadir “No Demolición sin compensación” al Derecho Civil Los Sres Prior acuden al Senado. 24.06.2015.
Las asociaciones claman evitar más casos así.
Los Sres Prior llevan viviendo 7 años en su garaje y mañana llevan su caso al Senado español. Su licencia fue anulada. Llevan años en una travesía jurídica por el desierto pidiendo que se les indemnicen, pues adquirieron su licencia de buena fe.
Se vota un cambio en la ley que evitaría más casos como el de los Sres Prior. La iniciativa nace de las asociaciones de afectados (originalmente
AMA, ahora con el apoyo de AUAN, SOHA.ES, CALU, FAUN, AUN). Ha sido adoptado del Parlamento Cántabro y ha sido acogido y presentando
en el Senado por el PSOE y el grupo parlamentaria EPC aunque al PP también se le pidió apoyasen esta enmienda.
El cambio no ayudaría directamente a los Sres Prior, pero evitaría más casos de demoliciones de viviendas, adquiridas de buena fe, mediante la
revocación de sus licencias sin la previa garantía de una adecuada indemnización.
Asociaciones de diversas partes de la geografía española, de norte a sur, acudirán al Senado. Se espera una representación de dichas asociaciones
de unas 60 personas. Se prevé una rueda de prensa en el Senado a las 13:15 horas, y posteriores reuniones de los afectados con diversos grupos
políticos del Senado.
El PP de Cantabría apoyó el cambio que se va a votar y ha habido ciertas indicaciones que el PP sería favorable a esta clase de cambios para
proteger a terceros de buena fe, en la línea del reciente cambio al Código Penal. No obstante no está claro el sentido de su voto en el pleno de este jueves. Las asociaciones claman a favor de la aprobación y piden comprensión y ayuda a nuestros representantes políticos.
Finalmente la votación del Senado fue casi unánime (un solo voto en contra) en la aceptación de la enmienda en la ley.

como la provisión de un sistema de apoyo para todos los miembros

El Comité trabaja en nombre de la membresía, pero los individuos
también puede proporcionar una fuente de consuelo para los demás
(es decir. “No se encuentra en su propio”)
Las noticias de esta semana de Madrid es un gran triunfo, pero el
siguiente e-mail debe ser considerado como no es menos importante.

Sólo he sido miembro de SOHA.ES desde el comienzo del año.
Durante este corto tiempo he llegado a ser muy conscientes del gran trabajo que usted y todos los interesados hacer para todos nosotros
miembros de SOHA.ES.
Mi hermano y yo hemos heredado una propiedad en Alcaucín, con todos sus problemas ilegales supuestas.
No experimentan en consecuencia una propiedad en España – que es extremadamente desalentadora en sí mismo – y mucho menos con
todos estos problemas ilegales agregados en la cima!
Para contar con el apoyo de una organización como SOHA.ES y todos los muy buena gente como usted es muy reconfortante y tranquilizador.
Apreciamos mucho todo su trabajo duro y compromiso que le das a SOHA.ES en nombre de todos nosotros.
