SOHA.ES AGM WILL BE HELD ON JANUARY 21st, 19.30 CAMPING RESTAURANT VINUELA

You are probably aware that almost all houses built on the campo in Andalucía are illegal. New rules have been issued in January of 2012 which establishes that they will remain illegal, unless built before 1975.

SOHA.ES (Safe Our Homes Axarquía) is one of the most active organizations in Andalucía that tries to find a solution for this problem by joining forces. So far we have been meeting with Spanish, foreign and European politicians, organized demonstrations, written letters of concern to Junta, Ministries and Ambassadors, coordinated with similar organizations elsewhere in Andalucía, made an inventory of the most urgent problems to address and made an inventory of our legal position.

In Andalucía there are an estimated 300.000 houses in this situation. For the Axarquía, the estimate is 15.000 houses. Unless there is a legal procedure started against your property (of which most of us were not even aware) and unless your house is built on now protected land, the best that can happen under current legislation is that your house is formally declared illegal, but the existence of the house and the use of the house as residence will be tolerated. What all of us stand to lose is the difference in value between a legal and an illegal house, which might be something around a 30% loss in value.

SOHA.ES together with AUAN (Almería) has finally forced a modification in the actual land law (LOUA). Our most urgent concern was to avoid the demolition of houses built on irregularly segregated land. As you probably know by now, the statute of limitation (6 years) did not apply to those houses and they were always exposed to demolition. The continuous efforts of SOHA.ES and AUAN made this possible with contributions of only 25€/house/year, when some of you have spent thousands of Euros on lawyers with a zero end result.

We still have a large list of urgent modifications that could benefit you and thousands of others that are affected, many of them ignoring their situation or preferring to ignore them: “there is none as blind as those who do not want to see”.

SOHA.ES will celebrate its next Annual General Meeting on Wednesday the 21st of January 2015. We would like to welcome all members. Friends of SOHA.ES are also welcome although they will not be entitled to vote. You can sign up or renew as a member on the same evening. The meeting will be held in the restaurant Camping La Viñuela at 19.30.

REUNIÓN ANUAL DE SOCIOS 2015, ENERO 21, 19.30 Restaurante Camping Presa de la Viñuela

Ustedes ya saben que la casi totalidad de las viviendas construidas en el campo son ilegales. El Decreto 2/2012 establece que toda vivienda construida en Suelo No Urbanizable (SNU) posterior a 1975 será considerada como ilegal.
SOHA.ES (Salvemos Nuestras Casas Axarquía) es una de las asociaciones más activas de Andalucía en buscando soluciones viables al caos urbanístico de nuestra comunidad. Nos reunimos con gran frecuencia con los responsables políticos de todos los partidos, tanto a nivel municipal, comarcal, provincial, regional, nacional y europeo. También hemos redactado, junto con nuestros asesores jurídicos, sendas propuestas de modificación de la LOUA con el propósito de devolver la seguridad jurídica perdida.

Andalucía cuenta con unas 300.000 construcciones en situación irregular de las cuales unas 15.000 corresponden a la Axarquía. El marco legal actual condena estas viviendas a un Asimilado a Fuera de Ordenación (AFO). La vivienda AFO es una vivienda ilegal que solo tiene el derecho a obras de estricto mantenimiento y ornato. No se le permite obras que pueden incrementar su valor y su vida útil queda limitada ya que no se le permite obras de consolidación. Por ello, la vida útil de esta vivienda es muy inferior a la vivienda legal, afecta a su valor en el mercado inmobiliario y afecta a la herencia que podríamos dejar a nuestros hij@s. Este breve análisis solo es válido si su vivienda no se encuentra en curso de un Expediente de Protección de la Legalidad Urbanística y que su vivienda no esté en una zona de especial protección.

SOHA.ES y nuestra asociación gemela AUAN de Almería han finalmente podido forzar un primer cambio en la LOUA. Nuestra prioridad era evitar las demoliciones de viviendas en parcelaciones urbanísticas en SNU. Como probablemente saben, la prescripción de 6 años para la vivienda irregular excluye a las viviendas en parcelaciones irregulares. La lucha sin tregua de SOHA.ES y AUAN se ha visto por fin recompensada con una modificación de la LOUA que se está tramitando en estos momentos en el Parlamento Andaluz. Todos estos esfuerzos se han conseguido con una cuota de tan solo 25€/vivienda/año, contrastando con los miles de Euros que algunos han pagado a sus abogados con unos resultados cercano al cero.
Nos quedan muchos cambios por promover que beneficiarán a miles de personas con viviendas en SNU. La gran mayoría ni siquiera son conscientes de su problemática, otros prefieren ignorarlo y meterse la cabeza en la arena como los avestruces.
