Another blow to the Priors

Latest verdict in the Vera demolition saga declares licence illegal as lawyers press on for compensation. This according to Costa News.

The supreme court of Andalucia this week declared the licence granted for the construction of the home of Len and Helen Prior in Vera, demolished under a court order in 2008, illegal.

The verdict was issued in the case of the Junta of Andalucía against Vera council, in which the Junta claimed that the local authority had wrongfully issued the building licence for the house in 2003.

The licence was declared illegal at a previous hearing but the decision was appealed by the council, but this week it emerged that it had lost that appeal, and the decision is now final.

The verdict is an important step in the case brought by Mr and Mrs Prior against the council, the subject of separate court proceedings in Almería city, where the judge declared that the court was unable to rule whether or not the Priors were entitled to compensation from the council, pending a final judgment on the legality of the planning licence.

The case has been ongoing since 2008, when the Priors’ luxury villa in La Loma, Vera, in which they had invested all their savings and hoped to spend their retirement, was demolished by the Junta, Andalucía’s regional government.
